Planning to open a firecracker shop or sell fireworks from a temporary Diwali stall? You must obtain the required licence before storing crackers for sale or starting business. The Explosives Rules, 2008 regulate the possession and sale of fireworks in India.
For a standard firecracker shop licence, an applicant generally submits Form AE-5 under Rule 113. The licensing authority issues the permission in Form LE-5 after examining the application, premises and required safety clearances. Temporary festival stalls also need permission under Rule 84.
The central rules provide the legal framework, but the application process, fee, last date and local requirements can differ between states and districts. This guide explains the licence types, eligibility, documents, application procedure, inspection process and important safety conditions you should know before applying.

Who Needs a Firecracker Licence in India?
Rule 7 of the Explosives Rules, 2008 prohibits a person from manufacturing, importing, exporting, transporting, possessing for sale or using explosives unless the activity is authorised or covered by a licence under the rules.
Fireworks are covered by these provisions. Therefore, you generally need the appropriate licence if you plan to:
- Open a permanent firecracker shop.
- Sell fireworks from a temporary festival stall.
- Store crackers at a shop or godown for commercial sale.
- Keep fireworks for sale at another business premises.
- Possess and sell fireworks in quantities that require a licence.
The requirement does not depend on whether you operate throughout the year or only during Diwali. A temporary seller must also obtain the required permission.
When Is a Licence Not Required?
Rule 9 provides specific exemptions from the licensing requirement. Two important exemptions relate to personal possession and the sale of certain small fireworks.
- Fireworks for personal use: A person may possess up to 100 kg of fireworks for their own use, provided they do not hold them for sale.
- Amorces and sparklers: Rule 9 also exempts possession and sale from a shop of amorces and sparklers up to 100 kg, subject to the exact wording of the rule.
These are limited exemptions. They do not allow someone to operate a general firecracker shop or store ordinary fireworks for commercial sale without the required licence.
Buying fireworks for personal use is different from selling them. A consumer does not need a shop-sale licence merely because they purchase crackers for private use.
Read Rules 7, 9 and 10 of the Explosives Rules, 2008.
Types of Firecracker Shop Licence
The Explosives Rules provide for a licence in Form LE-5 for specified possession and sale activities. For ordinary retail sellers, the main distinction is between a regular shop and a temporary festival shop.
1. Permanent Firecracker Shop Licence
If you want to operate a regular firecracker shop, you need a licence covering the proposed premises and the quantity of fireworks you intend to possess and sell.
The licensing authority examines the shop location, construction, storage capacity and safety arrangements before granting permission.
A permanent licence is not automatically available in every state. Some state or district policies may restrict the grant of new permanent licences. Confirm the current local policy before renting or purchasing commercial premises.
2. Temporary Firecracker Shop Licence
A temporary licence is meant for selling fireworks during festivals such as Diwali. Rule 84 allows the District Magistrate to issue temporary licences for the possession and sale of fireworks from temporary shops during festivals.
The temporary shop must follow the prescribed construction, spacing and safety conditions. The Form LE-5 licence specifies a maximum validity period of 15 days for temporary licences issued under Rule 84.
District authorities generally announce the application window, approved selling locations and submission deadline before the festival. Applicants should follow the latest notice issued by their district rather than relying on an old year's schedule.
Form AE-5 and Form LE-5: What Is the Difference?
Applicants often confuse Form AE-5 with Form LE-5. Both are important, but they serve different purposes.
| Form | Purpose |
|---|---|
| AE-5 | Application for approval, grant, amendment or transfer of a licence in Form LE-5. |
| LE-5 | The actual licence authorising the activities covered by the relevant category, including possession and sale of fireworks from a shop. |
Form AE-5 is prescribed under Rule 113 of the Explosives Rules, 2008. You submit this application with the documents required for the relevant licence category.
If the authority approves your application, it issues the licence in Form LE-5, subject to the applicable conditions.
You can download the official application form from the Petroleum and Explosives Safety Organisation website.

How Much Firework Stock Can You Keep Under an LE-5 Licence?
The permitted quantity depends on the category mentioned in the licence. Do not assume that every LE-5 licence allows the same amount of stock.
For the standard retail category under Article 5(b) of Part 1 of Schedule IV, the rules specify the following maximum quantities at any one time:
| Type of Fireworks | Maximum Quantity |
|---|---|
| Manufactured fireworks of Class 7, Division 2, Sub-division 2 | 100 kg |
| Chinese crackers or sparklers | 500 kg |
The rules also provide a separate category under Article 5(f) for possession and sale of larger quantities. This category covers more than 100 kg but not more than 300 kg of the specified manufactured fireworks, along with more than 500 kg but not more than 1,200 kg of Chinese crackers or sparklers. The licence for this category is issued by the Controller of Explosives, subject to the applicable requirements.
The quantity limits refer to the stock permitted at one time. Your licence will specify the approved types and quantities. Never keep more stock than your licence allows.
Who Issues the Firecracker Licence?
The licensing authority depends on the location and the category of licence you need.
According to the PESO Licensing System for District Authorities (LSDA), the authorities empowered to grant the relevant district-level licences include:
- District Magistrate (DM): The District Magistrate is the licensing authority for the applicable district-level LE-5 categories.
- Additional District Magistrate (ADM): An Additional District Magistrate may also exercise the relevant licensing powers.
- Commissioner of Police: In an authorised police commissionerate area, the Commissioner of Police may handle the relevant licensing work.
- Deputy Commissioner of Police: An authorised DCP may also exercise the applicable powers.
- Controller of Explosives: The higher-quantity category under Article 5(f) is assigned to the Controller of Explosives.
The local office may route the application through the SDM, Tehsildar, City Magistrate or another designated authority for verification.
For example, the Bhubaneswar-Cuttack Police Commissionerate instructs applicants to submit Form AE-5 to the Commissioner of Police. The office then obtains the required local NOCs before considering the LE-5 licence.

Documents Required for a Firecracker Licence
The documents depend on the state, licence category and premises. The central application requirements and local service checklists should be considered together.
For a standard LE-5 shop licence, prepare the following documents where applicable:
- Completed Form AE-5.
- Passport-size photograph of the proposed occupier.
- Documentary evidence showing the nomination of the occupier.
- Site plan of the proposed shop or premises.
- Plan showing storage capacity, approach road and surrounding facilities.
- Documents showing compliance with the applicable shop safety conditions under Rule 86.
- Proof of ownership or lawful possession of the premises.
- Rent agreement and owner's consent or NOC if the premises are rented.
- Identity and residential proof, as required by the local authority.
- Affidavit in the format prescribed by the district, if required.
- Prescribed application or licence fee receipt.
Some state portals also ask for PAN, property tax receipts, land records or previous licence details. These are local requirements and may not apply uniformly throughout India.
The central Schedule IV checklist specifically mentions Form AE-5, the shop plan, the occupier's photograph and proof of nomination, and the prescribed licence fee for the relevant category.
Information You Must Provide in Form AE-5
Form AE-5 asks for information about the applicant, the proposed premises and the fireworks to be kept at the shop.
Important details include:
- Purpose for which the licence is required.
- Name and status of the applicant.
- Age and complete postal address of the applicant.
- Address and identification details of the proposed shop.
- Police station and nearest railway station details, where requested.
- Name, class, division and quantity of fireworks proposed to be possessed.
- Information about relevant past convictions or orders asked for in the application.
- Details of earlier explosives licences, including any cancellation or non-renewal.
If the applicant is a partnership firm or company, the form also requires relevant information about its partners, directors, occupier or authorised representative, as applicable.
Provide correct information and ensure that the details match your supporting documents. The application contains a declaration regarding the accuracy of the information supplied.
How to Apply for a Firecracker Licence in India
The central application form is the same, but the submission method depends on your state and district. Some authorities accept applications through online portals, while others require applicants to visit the licensing office.
Step 1: Decide Which Licence You Need
First, decide whether you want to operate a regular shop or sell crackers from a temporary festival stall.
Also calculate the maximum quantity of fireworks you intend to keep at one time. The licence category and competent authority depend on the type and quantity of fireworks involved.
Step 2: Find the Licensing Authority
Check your district administration website or police commissionerate website to identify the authority responsible for granting the licence.
Look under sections such as Licences, Public Services, Notifications, Firecracker Licence or Temporary Fireworks Shop Licence.
If you cannot find the application details, contact the District Magistrate, SDM or authorised licensing office.
Step 3: Select a Suitable Shop or Stall Location
Choose the premises only after checking the applicable safety and location requirements. A shop that does not meet the prescribed construction or distance conditions may not receive approval.
Keep the ownership papers, rent agreement or owner's consent ready.
Step 4: Download and Complete Form AE-5
Download Form AE-5 from the official PESO website or obtain the form through your state service portal.
Enter the applicant's details, proposed premises, licence purpose and maximum quantity of fireworks. Attach the required plans and supporting documents.
Step 5: Submit the Application
Submit the application through the available method in your district:
- State government service portal.
- Police commissionerate citizen portal.
- District Magistrate or Collector office.
- SDM or other designated licensing office.
- Authorised e-Seva or citizen service centre, where available.
For an online application, save the application reference number. For an offline application, obtain an acknowledgement or receipt.
Step 6: Pay the Applicable Fee
Pay the application or licence fee through the payment method prescribed by the licensing authority. Some districts accept online payment, while others may issue a challan or require payment through a specified office.
Keep the payment receipt for future reference.
Step 7: Complete Police, Revenue and Fire Verification
The licensing authority may seek reports or NOCs from the police, revenue office, fire department and other local authorities.
The concerned officials may inspect the proposed premises and verify whether the location and safety arrangements meet the applicable requirements.
Step 8: Wait for the Licensing Authority's Decision
The licensing authority examines the application and the reports received from the concerned departments. It may ask you to provide additional documents or clarify information.
The authority may grant or refuse the licence after completing the required scrutiny.
Step 9: Collect Your LE-5 Licence
If the authority approves the application, it issues the licence in Form LE-5 for the approved purpose, premises and quantity.
Read every condition printed on the licence. Start selling only after the licence becomes valid and the premises are ready for operation.
Police Verification, Fire NOC and Site Inspection
Verification is an important part of the licensing process. The licensing authority may obtain reports from different departments before approving the application.
The exact list of reports varies by location. Common checks include:
Police Verification
The police may verify the applicant's background and other relevant details. The authority may also check whether the proposed premises create any local safety or law-and-order concerns.
Revenue Verification
The revenue officer may verify the location, land or property details and the applicant's right to use the proposed premises.
Fire Department Inspection
The fire department may examine the premises and its compliance with applicable fire safety requirements. The inspection may cover access, nearby buildings and the safety arrangements required by the licensing authority.
Other Local NOCs
Depending on the state and location, the authority may also seek reports from the electrical inspector, municipal body or other departments.
For example, the Bhubaneswar-Cuttack Commissionerate lists NOCs from the local police station, Tahasildar, Fire Officer, Assistant Electrical Inspector and Municipal Authority before it considers issuing the LE-5 licence.
Read the official Bhubaneswar-Cuttack Police licensing procedure.
How to Apply Online for a Firecracker Licence
There is no single public application portal that replaces every state's licensing process. The online facility depends on the state government and the local licensing authority.
Here are some official examples:
| State or Region | Application Facility |
|---|---|
| Punjab | Punjab e-Services - Cracker Sale Licence |
| Odisha - Bhubaneswar-Cuttack Commissionerate | Odisha Police Citizen Portal |
| Odisha - State Investment Portal | GO SWIFT / Invest Odisha |
| Tamil Nadu | Applications may be invited through e-Seva Centres and district administration notices. |
| Puducherry | Karaikal District Official Website |
| Andaman and Nicobar Islands | North and Middle Andaman - Licensing Information |
These examples do not mean that the same portal or procedure applies throughout the state or country. Always check whether the service covers your district and the exact licence category you need.
Firecracker Licence Fees in India
The fee for a firecracker licence is not the same across all states and districts. The amount can depend on the licence category, stock capacity, service charges and the applicable state procedure.
For this reason, do not rely on a fee quoted for another district. Check the current amount on your state portal or ask the licensing authority before submitting payment.
For example, the Bhubaneswar-Cuttack Police Commissionerate's published instructions mention a ₹300 cash deposit with the application. Odisha's GO SWIFT portal also publishes separate services for temporary and permanent cracker-sale licences.
Check the Bhubaneswar-Cuttack Police application instructions.
Check Odisha's official service portal.
How Long Does It Take to Get a Firecracker Licence?
There is no single processing time that applies to every district in India. The time depends on the state service rules, licence category, application window and completion of the required verification reports.
Some state portals publish a notified service timeline. For example:
- Gujarat's published service notification lists 21 days for a temporary LE-5 licence and 60 days for a permanent LE-5 licence.
- Punjab's cracker-sale service portal lists a 30-day service timeline.
These are state-specific service timelines, not nationwide deadlines. The actual process may take longer if the application is incomplete or the police, revenue and fire reports are delayed.
For temporary festival licences, apply as soon as your district publishes the application notice. The authority may reject applications received after the closing date.
Safety Conditions for a Permanent Firecracker Shop
The Explosives Rules, 2008 prescribe construction and safety requirements for shops that store and sell fireworks. A shop must satisfy the applicable conditions before the licensing authority approves it.
Important requirements under Rule 83 include:
- The shop must be constructed using brick, stone or concrete and secured against unauthorised access.
- The storage area must be at least 9 square metres and not more than 25 square metres under the specified shop provision.
- The shop must be located on the ground floor.
- The premises must have the required separation from other parts of the building.
- The shop must not be located in a basement or mezzanine floor.
- The shop must not be under a staircase or lift.
- The premises must be accessible for firefighting.
- Electrical wiring and equipment must meet the prescribed safety requirements.
These are central rule requirements. The licensing authority may impose additional conditions based on the site and applicable local directions.
Safety Conditions for Temporary Firecracker Stalls
Rule 84 lays down conditions for temporary fireworks shops during festivals. These conditions are especially important when the district administration sets up a designated market or common selling area.
- Fireworks must be kept in a shed made of non-flammable material.
- The shed must remain closed and secured against unauthorised access.
- Temporary sheds must be at least 3 metres apart.
- The sheds must maintain a distance of at least 50 metres from protected works.
- The sheds must not face each other.
- Oil-burning lamps, gas lamps and naked lights must not be used in the sheds or within their safety distance.
- Fireworks displays must not take place within 50 metres of a shed.
- A cluster must not contain more than 50 shops under the rule.
The district authority may specify the approved location, layout, entry and exit arrangements and other conditions in its festival notice. Applicants should follow that notice along with the central rules.
Important Rules to Follow After Getting the Licence
Receiving an LE-5 licence does not mean that you can store or sell fireworks without restrictions. The licence holder must follow the Explosives Rules and every condition mentioned in the licence.
Keep these important restrictions in mind:
- Do not store more fireworks than the quantity permitted by your licence.
- Keep fireworks in the approved premises and in the prescribed manner.
- Do not allow unauthorised persons to access the storage area.
- Do not smoke or allow flames, naked lights or fire-causing articles near stored fireworks.
- Do not allow mobile phones, radio devices or other prohibited communication equipment within the restricted distance specified under Rule 10.
- Do not employ or allow persons below 18 years of age to enter premises licensed under the rules for the prohibited activities.
- Do not allow an intoxicated person to handle explosives.
- Purchase fireworks only from a licensed source.
- Sell only fireworks permitted under the applicable rules and licence conditions.
- Follow the applicable noise limits and restrictions on prohibited fireworks.
Rule 10(6) specifically restricts smoking, fire, lights, flammable substances and specified communication devices within 15 metres of a place where explosives are stored. The rules also restrict handling between sunset and sunrise, subject to the prescribed exception for proper illumination and guarding.
Noise Limits for Firecrackers
The Explosives Rules prohibit the manufacture or sale of sound-emitting fireworks exceeding the prescribed noise levels. The limits include:
- 125 dB(AI) at 4 metres from the point of bursting; or
- 145 dB(C) peak at 4 metres from the point of bursting.
For individual crackers forming part of a joined series, the permitted limit is reduced according to the number of crackers in the series.
Check the applicable rules and current court or government directions before stocking or selling fireworks. A shop licence does not override restrictions imposed by the state administration, pollution control authorities or courts.
Difference Between a Shop Licence and a Public Fireworks Display Licence
A licence to sell fireworks does not automatically authorise you to organise a public fireworks display.
| Purpose | Application Form | Licence Form |
|---|---|---|
| Possession and sale of fireworks from a shop | AE-5 | LE-5 |
| Possession and use of fireworks for public display | AE-6 | LE-6 |
If you want to organise a fireworks display at a wedding, public event, procession or other function, check the separate permission requirements. A shop-sale licence is not a substitute for an LE-6 display licence.

Common Mistakes That Can Delay or Reject a Firecracker Licence Application
Many applicants face delays because they select an unsuitable location or submit incomplete documents. Avoid these common mistakes:
- Applying after the deadline: Temporary festival applications are accepted only within the period announced by the district authority.
- Choosing an unsuitable site: A shop or stall that does not meet the prescribed safety and distance conditions may not receive approval.
- Submitting an incomplete site plan: The plan should contain the details required by the applicable licence category.
- Missing ownership or tenancy documents: The authority may require proof that you have the legal right to use the premises.
- Declaring the wrong stock quantity: State the maximum quantity you intend to keep at one time.
- Ignoring verification: Delayed police, revenue or fire reports can hold up the application.
- Providing incorrect information: Form AE-5 requires a declaration. Do not hide relevant information about previous licences or other matters asked in the form.
- Buying stock before approval: Do not start storing fireworks for commercial sale before obtaining the required licence.
Renewal of a Permanent Firecracker Licence
If you operate a permanent firecracker shop, check the validity period mentioned in your LE-5 licence. Apply for renewal through the licensing authority before the licence expires.
Rule 112 of the Explosives Rules deals with renewal and revalidation. The prescribed renewal application is made in Form RE-1, along with the original licence and the applicable renewal fee and documents.
A temporary licence issued under Rule 84 is different. It is valid for the specified temporary period and does not operate as a permanent shop licence for the next festival season. You must follow the district's fresh application process for the next season.
